  1. Assumption of Risk. Renter acknowledges that the activities for which the Bike is designed include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of the Bike and assumes full and complete responsibility.

  2. Acceptable Use. Renter agrees and acknowledges that he/she will be the sole operator of the Bike, and will use the Bike in a careful, safe and conscientious manner. Renter shall always observe and adhere to any rules and guidelines posted by Company, and any applicable laws or regulations. The bike(s) you are renting are designed for on road use ONLY. No racing, tricks or off-road riding allowed.

    All Bikes are required to remain on designated bike paths, roadways and trails. You're on vacation take your time enjoy the scenery and RELAX.

  3. Prohibited Activities. Renter shall not violate any of the following rules and regulations during his/her operation of the Bike:

    • There are no passengers permitted on the Bike unless equipped for multiple riders or expressly permitted by Company in writing prior to use.
    • There are hundreds of miles of paved bike trails in the South Baldwin County area use them. NO BIKE SHALL BE USED OFF-ROAD ON THE BEACHES & DEFINITELY NOT IN THE WATER. VIOLATION OF THIS RULE MAY RESULT IN YOU PURCHASING THE BIKE.
    • There are no alcoholic beverages permitted while using the Bike. Just as in a motorized vehicle Alabama State Law allows Law Enforcement Officers to charge you and take you to jail for driving under the influence.

  4. Unsafe Use. If at any time Company determines that Renter has engaged in an unsafe or hazardous use of the Bike, Company may immediately terminate the rental. Upon notification of termination, Renter must return the Bike to the designated return area immediately. If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her security deposit. Company shall determine, in its sole discretion, whether any behavior or activity is “unsafe or hazardous.”


  5. Condition of Bike upon Return. The Renter shall return the Bike to the designated return area clean and in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to the Bike during the rental period. Company shall retain any portion (or all) of Renter's security deposit as necessary to cover repairs for such damages. To the extent that damages to the Bike exceed the amount of the security deposit, Renter shall be billed by Company for the full amount of damages caused by Renter during the rental period, including reasonable attorney's fees if necessary.


  6. Late Return. Bikes returned to the designated return area more than 10 minutes late shall incur an additional 1 hour charge of $10. More than an hour late will result in a 1 day charge.
 
ALABAMA STATE LAW:

Section 32-5A-284 Duties of person regularly engaged in business of renting bicycles. (a) A person regularly engaged in the business of renting bicycles shall require each person seeking to rent a bicycle to provide his or her signature either on the rental form or on a separate form indicating both of the following: (1) Receipt of a written explanation of the provisions of this article and the penalties for violations. (2) A statement concerning whether a person under the age of 16 years will operate the bicycle in an area where the use of a helmet is required. (b) A person regularly engaged in the business of renting bicycles shall provide a helmet to any person who will operate the bicycle in an area requiring a helmet, if the person does not already have a helmet in his or her possession. A reasonable fee may be charged for the helmet rental. (c) A person regularly engaged in the business of selling or renting bicycles who complies with this article shall not be liable in a civil action for damages for any physical injuries sustained by a bicycle operator or passenger as a result of the operator's or passenger's failure to wear a helmet or to wear a properly fitted or fastened helmet in violation of this article.
